Terms of Use

The agreement that governs your use of Boringua.

These Terms of Use (the “Terms”) are a legal agreement between you and Boring Projects Ltd, a company registered in New Zealand (“Boring Projects”, “we”, “our”, or “us”), for your use of the Boringua mobile application and related services (together, the “App”). These Terms also serve as the End-User License Agreement (EULA) for the App.

By downloading, installing, or using Boringua, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Boringua. By using the App you confirm that you meet this requirement. Boringua is not directed to children under 13.

2. Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use Boringua for your personal, non-commercial use on Apple or Android devices that you own or control, as permitted by the App Store and Google Play terms.

This licence governs your use of Boringua's software. Third-party software and dictionary material are also covered by their own licences, identified in Acknowledgements and Section 8. Nothing in these Terms limits permissions granted to you under those licences, including rights to copy, adapt, or use open-licensed material commercially.

This licence is also subject to the Apple Licensed Application End User License Agreement (the “Standard EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with the Standard EULA in relation to the Apple App Store version of the App, the more protective term for the user applies; otherwise these Terms govern.

For the Apple App Store version of the App, you also acknowledge that: these Terms are between you and Boring Projects Ltd only, not with Apple, and Apple is not responsible for the App or its content; Apple has no obligation to provide any maintenance or support for the App; if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, and to the maximum extent permitted by law Apple has no other warranty obligation; Boring Projects Ltd, not Apple, is responsible for addressing any claim relating to the App, including product liability, any failure to conform to legal or regulatory requirements, consumer protection claims, and any claim that the App infringes a third party’s intellectual-property rights. You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

3. Things you may not do

The restrictions below apply only to the extent permitted by applicable law and do not restrict any rights granted under the third-party licences identified in Acknowledgements and Section 8. In particular, they do not prohibit copying, modification, extraction, redistribution, commercial use, or creation of another dataset where the applicable licence permits it.

You can use Boringua as a guest, or create an account by signing in with Apple, Google, or email. You are responsible for maintaining the security of the account you sign in with and for activity that happens under it. Tell us promptly if you believe your account has been accessed without your permission. You can delete your account at any time from within the App; deletion removes your synced learning data as described in our Privacy Policy.

5. Your content

Boringua lets you save words, build word lists, and record your review history and streaks (“Your Content”). Your Content belongs to you. You grant us a limited licence to store, process, and sync Your Content across your devices solely to provide the App to you. We do not sell Your Content or use it for advertising.

6. Scanning with the camera

Boringua can turn a photograph into words to learn. The photograph does not stay on your device: we transmit it to our artificial-intelligence provider, OpenAI, which reads it and returns the result. Our Privacy Policy sets out what happens to the photograph and what we keep afterwards.

7. Boringua Pro subscriptions

Boringua offers an optional auto-renewing subscription (“Boringua Pro”) that unlocks additional features and content.

8. Intellectual property

Boringua includes software, design, branding, and learning content created or commissioned by Boring Projects Ltd, together with third-party material. We reserve our rights in our software, branding, and independently created content to the extent recognised by applicable law. Third-party rights remain with their respective holders. We do not claim exclusive ownership of source-derived dictionary material, or of words, facts, or other material not protected by intellectual-property law.

Some learning content is generated or edited using AI. Using AI does not remove licence conditions that apply to source material or adaptations. The dictionary sources, modifications, and applicable licences are identified below and in the App's Acknowledgements screen. Those licences govern reuse of the material they cover and take precedence over any conflicting restriction in these Terms. They do not grant rights to Boringua's trademarks or to separately protected software or independently created content.

These Terms do not transfer ownership rights to you. Feedback or suggestions you send us may be used without any obligation to you.

Dictionary data

Boringua combines human editing and review, AI-assisted content creation, and dictionary material from the sources credited below. Source definitions may be shown when a Boringua definition is unavailable. We also use source-derived linguistic information to support dictionary lookup and learning.

Boring Projects Ltd has selected, cleaned, reformatted, combined, corrected, and supplemented this material for Boringua. Our example sentences and audio are produced for Boringua rather than copied from the dictionary sources listed below. Source-derived material and adaptations remain subject to the applicable source licences, including where AI is used to assist an adaptation.

Wiktionary, via Kaikki.org

Boringua uses material contributed by Wiktionary contributors, extracted from English Wiktionary through Kaikki.org / Wiktextract, for its Spanish, French, Italian, and Chinese dictionaries. Thank you to the contributors and to Tatu Ylönen and the Wiktextract contributors for the extraction tools. The material has been modified and supplemented as described above.

CC-CEDICT

Boringua's Chinese dictionary also includes material from CC-CEDICT and its contributors, distributed by MDBG. CC-CEDICT continues the CEDICT project started by Paul Denisowski. The material has been modified and supplemented as described above.

Rights and reuse

The source-derived material described above is available under its applicable Creative Commons Attribution-ShareAlike licence. Boring Projects Ltd makes its copyrightable adaptations of that material available under CC BY-SA 4.0. You may reuse that material, including commercially, subject to the applicable licence's attribution, change-notice, ShareAlike, and other conditions.

These notices do not place Boringua's software, branding, or independently created content under a Creative Commons licence. Boring Projects Ltd reserves its rights in those elements to the extent recognised by applicable law, subject to any separately identified third-party rights. We do not claim exclusive rights over source material or facts in the public domain.

The credited projects and contributors do not sponsor or endorse Boringua. For a content correction or attribution concern, please contact Boringua with the language, word, and relevant source reference.

9. Third-party services

Boringua relies on third-party services (for example, Apple, Google, and email for sign-in; Apple and Google for payments; RevenueCat for subscriptions; Firebase for App Check and Crashlytics; and OpenAI for reading the photographs you scan). Your use of those services is also subject to their own terms. The open-source components bundled in the App are listed, with their licences, in the App’s Acknowledgements screen.

10. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LANGUAGE CONTENT WILL BE COMPLETE OR ACCURATE. THIS INCLUDES ANY RESULT PRODUCED BY THE CAMERA OR ANY OTHER AI FEATURE, WHICH IS GENERATED AUTOMATICALLY AND MAY BE WRONG, INCOMPLETE, OR UNSUITABLE. Nothing in these Terms limits any rights you have as a consumer under the New Zealand Consumer Guarantees Act 1993 or other mandatory consumer law that cannot be excluded.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORING PROJECTS LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR NZ$50.

12. Your responsibility for what you submit

You are responsible for what you choose to send us, and in particular for the photographs you scan. If someone brings a claim against us because of something you submitted, or because you used the App in breach of these Terms or of the law, you agree to cover our resulting losses and reasonable legal costs, to the extent the claim arises from what you did.

This does not apply to anything caused by us, and it does not limit your rights under the New Zealand Consumer Guarantees Act 1993 or any other consumer law that cannot be excluded. If we want a claim covered, we will tell you promptly, give you the chance to be involved, and will not settle it without asking you first.

13. Termination

You may stop using Boringua and delete the App at any time. We may suspend or end your access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the App. Your continued use of Boringua after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of New Zealand, and you and Boring Projects Ltd submit to the non-exclusive jurisdiction of the New Zealand courts. This does not deprive you of the protection of mandatory consumer laws of the country where you live.

16. General

If any part of these Terms turns out to be unenforceable, that part is narrowed or removed only as far as necessary and the rest stays in force. These Terms and our Privacy Policy are the entire agreement between us about the App, and replace anything said beforehand. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours to whoever takes over Boringua, and we will tell you in the App if that happens.
